Terms of Use

1. Acceptance

By using “Qirtas” (the “App”) you agree to these terms and to the Privacy Policy. If you do not agree, do not use the App.

2. Nature of the App and ownership

The App is an independent product fully and exclusively owned by Yousuf Ghulam Nabi (the “Developer”). It may be embedded in other apps developed by the Developer under a right of use only, and no ownership right in it passes to those apps or to any other party.

4. Saving and backup

Automatic saving and cloud saving are aids only, and the Developer does not guarantee that your boards will remain or will not be lost due to a device failure, deletion of the App, a sync error, or a conflict between two edits on two devices. Keep a backup of what matters to you, such as exporting to a file.

When cloud saving is enabled, the newer copy may replace the older one, so do not edit the same board on two devices at the same time.

Your boards are encrypted on your device with a key kept in the operating system's secure storage. If this key is lost (for example by clearing the App's data or resetting the device), boards that exist only on the device may become unreadable, and the Developer cannot recover them. Keep an exported or cloud copy of what matters to you.

In the web version your boards are stored only in your browser and there is no cloud saving; they may be deleted by clearing the browser or site data, by private browsing, or by the browser itself deciding to clear its storage. You are responsible for exporting backups of them, and the Developer is not liable for their loss.

5. Third-party services

Cloud saving takes place in your Google or Microsoft account, fonts are downloaded from Google Fonts, and optional handwriting recognition (on Android and iOS) is done through Google ML Kit, which downloads the language model from Google once. These services are subject to their providers' terms and policies, and the Developer is not responsible for their outage or for changes to their terms.

On Windows, Google sign-in passes through an intermediary on Cloudflare operated by the Developer. Converting Word, PowerPoint and Excel files to PDF uses the Microsoft Office installed on your device under your own license, and the Developer does not provide it and is not responsible for how it works.

6. Sharing by QR code

When you share a board, the App displays a QR code on your screen. You are responsible for whom you show this code to and for what you share. The content is transferred encrypted, and the encryption key is inside the code itself, so show the code only to someone you want to receive your board. The Qirtas app must be installed on the other device in order to scan the code.

This feature is not available in the web version.

7. Problem reports

The App sends a problem report only after showing you its type and obtaining your consent, as set out in the Privacy Policy.

8. Use as a guest

You can use the App as a guest without linking an account, by creating up to five boards. After they are used up, your boards remain available to you only for writing on them with the pen, erasing, and deleting; creating new boards, importing files, using the remaining tools, exporting and sharing are not allowed until you sign in with your Google or Microsoft account.

The Developer may change this limit or its conditions in the future after notifying you inside the App.

The five-board limit does not apply in the web version because it offers no sign-in; the Developer may change this in the future after notifying you.

9. Audio recording

The audio recording feature is optional, and a notice appears before each recording. You are responsible for respecting the rights of others and the regulations of your educational institution, so do not record the voice of the lecturer or anyone else without their permission. Recordings are stored on your device only.

The Developer may disable this feature or stop it for all users at any time, without deleting your recordings from your device.

The Android app may refuse to run on a rooted device, on an emulator, while developer options or USB debugging are enabled, or when tampering with the app or its signature is detected. This is to protect your data and is not a defect in the App.

The web version requires a modern browser that supports IndexedDB, WebCrypto and WebAssembly, and some features may differ between browsers. The following are not available in it: cloud saving, sharing by QR code, handwriting recognition, and converting Office files.

12. Intellectual property and license

The App, its name, logo, design and code belong solely to the Developer. You have a limited, non-exclusive, non-transferable personal license to use it, and its name or logo may not be used without the Developer's written permission.

13. Availability and change

The Developer does not guarantee uninterrupted or error-free operation, and may update, modify or discontinue features.

The App is currently in a trial stage and is distributed directly from its official website, not through app stores; it may contain errors and its features may change. Android and Windows may display a warning at installation for this reason. Install the App only from the official website (qirtas.namari8.com) and verify the published file fingerprint. Use the web version only from its official address (qirtas.namari8.com/board).

14. Disclaimer

The App is provided “as is”. To the extent permitted by applicable law, the Developer is not liable for indirect damages, nor for what results from the loss of boards, the outage of third-party services, or misuse by the user. This does not include what cannot be excluded by law, such as liability for fraud or gross negligence.

15. Termination

You may stop using the App at any time by uninstalling it (or by clearing the site data in the web version). The Developer may restrict or stop access for anyone who violates these terms.

16. Amendments

For any material amendment we will notify you inside the App before you continue using it, and we will update the date of this page.

17. Governing law and dispute resolution

These terms are governed by the laws of the Kingdom of Bahrain. We first seek to settle any dispute amicably, and if that is not possible, jurisdiction lies with the competent courts of the Kingdom of Bahrain.
